Dog Bite Laws
Liability for dog bites varies from state to state. In Oregon and Washington dog owners can be held liable for a victim’s economic damages including:
- Medical expenses
- Loss of income
- Past and future impairment of earning capacity
Non-economic damages, like pain and suffering, can also be recovered in some cases, but are more difficult to get. In Washington, dog owners are strictly liable for the dog’s actions. If your dog bites someone, you have to pay whatever amount of money a jury or judge determines is fair for the victim for both their economic and non-economic damages. In Oregon, however, the dog bite laws are slightly less strict. The victim doesn’t have to prove the dog owner knew or should’ve known the dog would bite in order to recover economic damages. It’s also more difficult for a victim to receive non-economic (pain and suffering) damages because dog owners are not held strictly liable for their dog if it bites someone. This simply means the victim would have to prove the dog had known “dangerous propensities” in order to receive non-economic damages.
